Welcome to Special Melodies! By accessing and using our services, including purchasing custom songs and interacting with our website, you agree to comply with the following Terms and Conditions. Please read them carefully before using our services.

By accessing or using the Special Melodies website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these terms, you must not use our services.

Special Melodies creates custom songs for individuals and businesses. Our services include personalized songwriting, composition, recording, and delivery of the finished product, based on the information you provide to us.

To place an order, you agree to provide accurate, current, and complete information during registration and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.

When you place an order for a custom song, you will provide information such as names, interests, specific messages, or themes to be incorporated into the song. We reserve the right to refuse or cancel orders that do not meet our standards or if we believe the request violates any applicable laws.

Once we begin creating your custom song, we will deliver it within 48 hours. Any delays due to unforeseen circumstances will be communicated promptly.

All payments for custom songs must be made in full at the time of order via the payment methods available on our website. By submitting payment information, you authorize us to charge the full amount for the song. All prices are listed in the currency indicated on our website and are subject to change without prior notice.

If a payment is declined or not processed for any reason, we may suspend or cancel your order.

Upon completion of the custom song, we will deliver the final product to you electronically via email or a downloadable link. The song remains the intellectual property of Special Melodies until payment is successfully completed in full.

Upon full payment, you are granted a non-exclusive, non-transferable license to use the custom song for personal, non-commercial purposes. You may share it with friends and family, play it at events, or use it as part of celebrations. Any commercial use or distribution without our express permission is prohibited.

Due to the personalized nature of our services, all sales are final. However, if you are unsatisfied with the final song due to a mistake made on our part (e.g., failure to incorporate provided details), we will work with you to make the necessary revisions.

Refunds will not be provided once a custom song has been created and delivered. Cancellations may be accepted before production begins, but any work already done may be charged.

Special Melodies retains ownership of the music, lyrics, and other intellectual property associated with the songs we create, including any drafts, recordings, or other materials used to produce the final song. You are granted a limited license to use the final song for personal purposes.

You may not modify, resell, or distribute the custom song or any part of it without written permission from Special Melodies.

By submitting any personal information, lyrics, messages, or other content for inclusion in your custom song, you grant Special Melodies the right to use that content for the purpose of creating your song. You confirm that you have the necessary rights to the content and that it does not infringe on any third-party intellectual property rights.

You agree not to submit any content that is unlawful, defamatory, offensive, or otherwise inappropriate.

Your use of Special Melodies is governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. Please review our Privacy Policy for more information.

Special Melodies is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services or the final custom song. We are not responsible for any errors or omissions in the content provided for the song, or for any technical issues during the delivery or playback of the song.

While we make every effort to deliver high-quality products, we cannot guarantee that the final song will meet every expectation or perfectly reflect the details provided. However, we will work with you to address any concerns and ensure a satisfactory result.

You agree to indemnify and hold Special Melodies and its affiliates harmless from any claims, damages, or losses resulting from your use of our services, your breach of these Terms and Conditions, or any infringement of third-party rights.

Special Melodies reserves the right to terminate or suspend your account and access to our services at any time for any reason, including violations of these Terms and Conditions. Upon termination, you will no longer be authorized to access or use our services.

These Terms and Conditions are governed by the laws of the state of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Delaware.
